Purpose of note
The purpose of this note is to remind European nationals (and their employers) that they need to apply for UK ‘Pre Settled Status’ by 30 June 21. If they don’t, they will need to follow the points-based immigration rules, which will make it much more difficult for them to work in the UK.
This is important to all Europeans that want to work in the UK, particularly for employees that are on Furlough and might have put the application off, or employees that have temporarily left the UK because of Covid and want to return.
Who needs Pre-Settled Status
Most Europeans who want to work in the UK need to have either Pre Settled Status, Settled Status or a Visa. This almost always applies – even to people who want to come to the UK to work for a short period (read about the short-term visitor rules here).
Settled Status and Pre Settled Status
Both Settled Status and Pre Settled Status allow you to work in the UK
- You can get Settled Status if you live in the UK for a continuous 5-year period.
- You can get Pre Settled Status if you have lived in the UK for as little as 1 day.
What does ‘living in the UK’ mean?
In this context, living in the UK means that you have lived in the UK:
- For at least 1 day that was on or before 31 December 2020; and
- That day was in the last 6 months before you apply.
Proof needed to apply for Pre-Settled Status
To prove that you lived in the UK all that is needed (at least in theory) is evidence like a flight ticket or bank statement. However, the Home Office has complete discretion on granting Pre Settled Status and reaches its decision after considering the proof that’s supplied. Therefore, having evidence of a UK address (rental contract, utility bills etc) makes the application much stronger. An employment contract will also help.
How much does an application cost
The Government does not charge a fee and you can do it yourself. Our standard fee for a simple application is usually around £500+VAT.
